    • ESC reserves the right to record the conversations between service professionals and consumers facilitated by ESC through the messaging/chat mechanism on the platform or the calls made through the virtual numbers provided to safeguard the privacy of consumers and service professionals. All the chat/messaging logs or call recordings can be used to but not limited to monitor and prohibit abuse, safeguard the rights of consumers and service professionals, resolve disputes.
    • If we deem it necessary, in our sole and absolute discretion, we may also ask for and collect supplemental information from third parties, such as information about your credit from a credit bureau (to the extent permitted by law), or information to verify any identification details you provide during registration.

  • Personal Information from Service Providers :

    • We collect personal information from Service Professionals offering their products and services. This information is partially or completely accessible to all visitors using Hofeto’s website or mobile application, either directly or by submitting a request for a service. Service Professionals and customers are required to create an account to be able to access certain portions of our Website, such as to submit questions, participate in polls or surveys, to request a quote, to submit a bid in response to a quote, and request information. - Service Professionals, if and when they create and use an account with ESC, will be required to disclose and provide to ESC information including personal contact details, bank details, personal identification details (such as PAN card, Aadhar card, phonebook, call logs etc.) and participate in polls or surveys or feedbacks etc. Such information gathered shall be utilized to ensure greater customer satisfaction and help a customer satiate their needs. The type of personal information that we collect from you varies based on your particular interaction with our Website or mobile application.
    • If you are a Service Professional and would like to post any information about yourself, we will require you to register for an Account. During the Account registration process, we will collect your business name, telephone number, address, zip code, travel preferences, a description of your services, a headline for your profile, first and last name, and email address. Other information may also be required to be provided to ESC whilst you avail and use Hofeto’s website or application. In addition, you may, but are not required to, provide other content or information about your business, including photographs and videos. We also may collect payment information, such as credit card information, from you.
    • Background Verification: The Service Professional acknowledges that as part of the on-boarding process, the Company or an entity /agency appointed or nominated by the Company (“Verifier”), may undertake background verification checks of the Service Professional in order to authenticate inter alia the genuineness and competency of the Service Professional. In light of the above, the Service Professional expressly consents to and acknowledges the following
      • The Service Professional does not and will not have any objection to ESC sharing the Service Professional’s personal information and documents, including but not limited to name, gender, date of birth, addresses, mobile number, email, education record, employment record, Aadhaar number, other government issued IDs such as Voter ID, PAN card, driving license etc. (collectively “Proprietary Information”) with the Verifier for the purpose of background checks and verification.
      • The Service Professional authorizes the Verifier to securely store the Service Professional’s Proprietary Information on their platform and understands that the Verifier shall endeavor to ensure confidentiality of the same.
      • The Service Professional acknowledges that the digital record of the Proprietary Information on the Verifier’s platform shall be accessible to ESC and ESC and their authorized users/partners/affiliates/contractors shall be entitled to access and update such digital record on the Verifier’s platform, including data, documents, certificates, verification reports, references, testimonials, etc. and shall be entitled to use the related services provided via the Verifier’s platform.
      • The Service Professional acknowledges that if the Service Professional is desirous of editing and/or deleting its digital record from the Verifier’s platform, it shall be entitled to do so by sending an email to such email address of the Verifier which shall be immediately provided by the Company to the Service Professional, and in such a manner as the Verifier requires the same.
      • ESC reserves its right to take appropriate actions (in its sole discretion) pursuant to the outcome of the background check and verification.
    • ESC reserves the right to record the conversations between service professionals and consumers facilitated by ESC through the messaging/chat mechanism on the platform or the calls made through the virtual numbers provided to safeguard the privacy of consumers and service professionals. All the chat/messaging logs or call recordings can be used to but not limited to monitor and prohibit abuse, safeguard the rights of consumers and service professionals, resolve disputes.
    • If we deem it necessary, in our sole and absolute discretion, we may also ask for and collect supplemental information from third parties, such as information about your credit from a credit bureau (to the extent permitted by law), or information to verify any identification details you provide during registration
    • All information disclosed by you shall be deemed to be disclosed willingly and without any coercion. No liability pertaining to the authenticity/ genuineness/ misrepresentation/ fraud/ negligence, etc. of the information disclosed shall lie on ESC nor will ESC in any way be responsible to verify any information obtained from you.

• Personal Information from Social Networking Sites :-

  • You may log into our Website through your Facebook account. If you do so, you must enter the email address and password that you use for your Facebook account.   ESC offers the opportunity to any user to share details of anyone who they think may be interested in ESC or our services. This information is recorded and used only to communicate with the referee using mediums including phone calls and email, based on the details provided to ESC. We believe that it is within the purview of the referrer to seek authorization to share the personal information of the referee. When the information is shared with ESC, it is deemed that the authorization has already been obtained by the referrer.

  During your interaction with ESC, you may also participate in polls, surveys and feedback and personal information including call logs during such interactions will be collected.   When you create an account with ESC and start (i) availing services through our Website, the Service Providers (ii) offer their services as a Consultant or Service Provider, you may be required to disclose information such as bank details, PAN card, Aadhaar card, credit card details, etc. in order for us to process your request. Additionally, ESC may also collect information related to the manner and mode of payments usually adopted by you on the Platform, including details of your bank account, credit card and debit card. The financial information collected may vary in accordance to your interaction with the Platform and our Service Professional.

• Device and location information :

  We collect information from your devices (computers, mobile phones, tablets, etc.), including information about how you interact with our services and information that allows us to recognize and associate your activity across devices and services. This information includes device specific identifiers and information such as location, IP address, cookie information, mobile device and advertising identifiers, browser version, operating system type and version, mobile network information, device settings, and software data. We may recognize your devices to provide you with personalized experiences and advertising across the devices you use. In addition, the information may also include your location.

  To offer our services, or to facilitate Hofeto’s Service Professionals to offer their services, personal information, partially or fully, is made available to Users of ESC. As an example, when you sign up to receive services from ESC, your contact information including phone number and email is shared with a Design Professional and/or Service Provider to offer his/her service for your project. Sometimes, the users are allowed to contact each other for marketing purposes as well.

In the event You have any grievances relating to the Privacy Policy, please inform ESC within 24 hours of occurrence of the instance from which the grievance has arisen, by writing an email to the Grievance Officer at ________ (eg:privacy@epicsoftwareconsultancy.com).

Any dispute, controversy or claim directly or indirectly caused by, arising out of or relating to this Privacy Policy will be governed by the laws of India and will be referred to confidential, mandatory and binding arbitration in Bengaluru, India. The arbitration will be conducted on an expedited basis before a single arbitrator appointed by ESC in accordance with the provisions of the Indian Arbitration and Conciliation Act, 1996. The arbitrator's award shall be substantiated in writing and will be final and binding on You and ESC. Subject to the above, You agree to submit yourself to the exclusive jurisdiction of the Courts in Bengaluru, India.
